Terms of Use

These Terms of Use govern your access to and use of the WebModuleX website located at webmodulex.com (the "Site"). By accessing the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Nature of the Site

The Site is an informational and promotional website for WebModuleX, a web development studio. Content published on the Site — including descriptions of services, case studies, and written materials — represents the professional opinions and experience of WebModuleX and is provided for general informational purposes only. Nothing on this Site constitutes legal, financial, or other professional advice.

2. Eligibility

You must be at least 18 years of age to submit an enquiry or enter into a contract with WebModuleX. By using the Site, you represent that you are of legal age and have the legal capacity to enter into binding agreements.

3. Client Agreements

Formal agreements for web development, design, or consulting services are governed by a separate written contract agreed between WebModuleX and the client at the commencement of each project. These Terms of Use do not constitute or modify any such contract.

4. Intellectual Property

Site content: All text, graphics, layouts, source code, and branding on this Site are the intellectual property of WebModuleX and are protected under Australian copyright law. You may not reproduce, republish, or redistribute any Site content without our prior written consent.

Client work displayed in portfolio: Case study descriptions and project outcomes are published with client permission. All trademarks, product names, and logos referenced in case studies remain the property of their respective owners. WebModuleX makes no claim of ownership over third-party marks.

Enquiry and project code: Upon full payment for a project, intellectual property in custom code, designs, and assets created specifically for a client transfers to that client as stipulated in the relevant project contract.

5. Acceptable Use

You agree not to use the Site to:

  • Transmit any unlawful, harmful, defamatory, or infringing content.
  • Attempt to gain unauthorised access to any part of the Site or our systems.
  • Introduce malware, viruses, or other harmful code.
  • Scrape, harvest, or systematically extract data from the Site without written consent.

6. Links to Third-Party Websites

The Site may contain links to third-party websites for reference purposes. WebModuleX does not endorse and is not responsible for the content, privacy practices, or accuracy of any linked third-party sites. Accessing such sites is at your own risk.

7. Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. WebModuleX does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by Australian law, WebModuleX and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site. Nothing in these Terms limits liability that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

9. Privacy

Your use of the Site is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

10. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, without regard to conflict of law principles.

11. Changes to These Terms

We reserve the right to update these Terms at any time. The "Updated" date above reflects the date of the most recent revision. Continued use of the Site following any changes constitutes your acceptance of the revised Terms.
